Terms and Conditions — TastyPlan

These Terms and Conditions ("Terms") govern the use of the mobile application TastyPlan operated by Kwargs, s.r.o.. By downloading or using the application, you agree to these Terms.

2. Service Description

TastyPlan is a mobile application designed for nutrition tracking, meal planning, food diary management and providing personalized recommendations including AI analysis of food photographs.

3. Registration and User Account

Registration conditions:

You must be at least 18 years old.
Provide truthful and current information.
Have a valid email address.
Agree to these Terms and Privacy Policy.

Account security: The user is responsible for protecting their login credentials and for all activities performed under their account. Report suspicious activity to hello@tastyplan.app.

4. Application Usage

Permitted use:

Personal nutrition and health tracking.
Recording food and beverages and their analysis.
Meal planning and goal setting.

Prohibited use: illegal purposes, providing medical diagnoses instead of qualified healthcare professionals, copyright infringement, creating fake accounts, disrupting service operations, or automated data extraction.

5. AI Analysis and Data Accuracy

AI functions provide estimates of portions and nutritional values and their accuracy is not one hundred percent. Information obtained in the application is informative and cannot replace consultation with a doctor or qualified nutrition counselor.

Important health warning: The application is not a medical device and is not intended for diagnosis, treatment or prevention of diseases. For health problems, consult a qualified healthcare professional.

6. Content and Intellectual Property

All application content (design, texts, images, algorithms) is protected by copyright and is owned by Kwargs, s.r.o. By uploading content, the user grants Kwargs, s.r.o. a non-exclusive, worldwide license to use this content for service operation.

7. Payments and Subscription

Basic features are available for free. Premium features are provided in the form of monthly or yearly subscription through App Store or Google Play. Subscription automatically renews unless cancelled by the user. Cancellation is done in the settings of the respective app store; after cancellation, access remains until the end of the paid period.

8. Cancellation and Termination

The user can cancel the subscription at any time and request account deletion at hello@tastyplan.app. Kwargs, s.r.o. may terminate or restrict access in case of violation of these Terms or service abuse.

9. Liability

The following provisions are formulated in accordance with legal limitations applicable in EU and SK.

Explicit statement of user requirement: Kwargs, s.r.o. ASSUMES no responsibility for health consequences resulting from using the application and does not provide compensation to users for health complications or losses resulting from application use.

Legal notice: Our company seeks to limit its liability to the extent permitted by law. This exclusion does not apply to cases of intentional conduct, gross negligence, or harm to the user's health or life, if such limitation is prohibited by law.

In addition to the above, to the extent permitted by law, Kwargs, s.r.o. is not liable for indirect damages, lost profits, or losses suffered by the user as a result of using the application, unless such exclusion is prohibited by law.

10. Data Protection

Processing of personal data is governed by the Privacy Policy available at www.chutnyplan.sk. Please read it as it forms part of these Terms.

11. Terms Changes

We may update the Terms. We will inform about substantial changes 30 days in advance in the application or by email.

12. Dispute Resolution

Before filing a lawsuit, we will try to resolve the dispute out of court. Contact us at info@kwargs.sk. Consumers also have the right to turn to the European platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.

13. Governing Law

These Terms are governed by the law of the Slovak Republic. Slovak courts have jurisdiction, unless legal regulations provide otherwise.
